Politica Migratoria Parte IV/Politica Internacional: Reconocimiento Internacional y su impacto sobre los Flujos Migratorios Ejemplos de Taiwan y Malvinas

El tercer interes (ver post anterior para leer sobre los dos primeros intereses) que vamos a trabajar hoy  es el reconocimiento del actor o los derechos de un actor sobre cierto territorio, por los otros Estados, es un verdadero acto  politico que tiene impacto nivel internacional y tener un impacto tremendo sobre los flujos migratorio, por ejemplo cuando Argelia reconocio la Republica Democratica  Arabe Sahrawi, llevando a Marruecos cerrar sos fronteras Argelia como represalia en 1994, alterando los flujos migratrios en la region.
En el caso de la Argentina es reconocido como sujeto legítimo en el sistema y éste reconoce a su vez a los otros Estados como sus pares e iguales. Al menos esto sucede a nivel jurídico, en términos de poder puede haber una gran asimetría entre los actores. Ahora, según como los actores se interrelacionen establecerán las reglas de juego que pueden variar según los grupos, pueden ser más o menos cooperativos, las relaciones de poder intrínsecas pueden ser condicionantes pero no definitivas. Lo que sí es una constante que subyace en las relaciones entre los estados es la búsqueda de satisfacer sus intereses y necesidades. La identidad del país, la visión del Estado de sí misma y como ésta es  vista, producen impacto sobre su comportamiento y sobre sus intereses.

Volviendo al tema del reconocimiento entre los Estados, tiene un efecto práctico importante en lo que se refiere a los migrantes, la emisión y reconocimiento de los documentos hábiles de viaje. Si Argentina no reconoce un cierto pasaporte no puede ingresar. El caso más común es con los ciudadanos Taiwaneses, Argentina  no reconoce a este país como tal, y si se interviene uno de sus pasaportes sería un acto de reconocimiento de éste y llevaría inevitablemente a un conflicto con el gobierno chino si sucediera de forma repetida. Está estrictamente prohibido intervenir este documento de viaje. Los taiwaneses están obligados a viajar con pasaportes Chinos o con un documento de viaje especial. Otro caso parecido, pero se trata más una cuestión de soberanía para la Argentina, es el caso de las personas  provenientes de Malvinas, por portar pasaportes británicos, al igual que el caso anterior no se interviene este documento de viaje porque sería el reconocimiento de la autoridad inglesa sobre las islas y sus habitantes. Para Argentina son argentinos, por ende no es necesario sellar un pasaporte cuando uno viaja de una provincia a otra.Es mas no tiene que radicarse  si vienen al pais simplemente se presentan.

The third interest that we are going to work on today is the need for a  State that must satisfy and have recognition of itself by other Sates, it a major  issue when a country recognizes another State, is a very important political act, that has an impact on the world stage. For example when Algeria recognized the Sahrawi  Arab Democratic Republic proved that in 1994 Morocco to close it borders with Algeria in reprisal.
 In the case is of Argentina ( the place from where I'm writing from) it is recognized as a legitimate subject in the  international system and it recognizes at the same time  by other States as its peers and equals, note this is the basis of international law, all States are equal on a legal level; in terms of power there may be a large asymmetry between actors. Now, according to how they  interact  actors establish rules which may vary according to the groups, they can be more or less cooperative, intrinsic power relations may  conditions things but are not definitive. What is a constant underlying the relations between States and the search to meet there respective interests and needs. The identity of each country, the State itself and how it sees itself and how it’s seen, has a big impact on their behavior and interest.

The issue of recognition between States has a very important practical affect on countries migratory policies and migrant’s movements or even if it possible in the first place, the issuance and recognition of travel documents, depends on countries international Recognition.  For example if Argentina (or any Country) does not recognize a travel document such as a Passport that you hold you cannot enter. The most common case on a international level is for the travel documents for Taiwanese citizen, Argentina (as many other countries like the United States of America) does not recognize this country as a independent State, and if one of their passports were to be stamped it would be an act of recognition, if this happen on a large scale this would inevitably lead to a conflict with the Chinese Government. The Taiwanese citizens are forced to travel with Chinese passports, or with a special travel document, if they want to travel to Argentina. Another similar case for Argentina, is the question of sovereignty over two island in the south Atlantic, it is the case of the people from Malvinas/Falkland (the second designation on this territory is wrong), they carry British passports, and as the same in the previous case is not consider a legal travel document for Argentina because it would be recognition of English authority over the Islands and their inhabitants. For Argentina they are Argentines, therefore it is not necessary to stamp there a passports, because it’s consider they have traveled from one province to another, internal travel. People from Malvinas don’t need to get Argentine residencies either they consider citizens they  have no need to go to their immigration serves, they have to go directly to the Registro Civil to get there IDs.
